What is a Civil Tort?

A civil tort is an act or omission which gives rise to injury or harm to another and amounts to a civil wrong for which courts impose liability. For example. If a custodian mops the floor and forgets to put out the wet floor sign and someone slips and falls injuring themselves, a negligence tort can be filed. Tort lawsuits are the largest category of civil litigation and can involve a wide range of personal injury cases. However, there are broken down into 3 main types: intentional torts, strict liability, and negligence.

Examples of 3 Types of Torts

Intentional Torts

Intentional torts occur when an individual or entity intentionally engages in conduct that causes injury or damage to another. For example, hitting someone in a fight would be considered a battery tort. Other examples of intentional torts:
• Defamation
• Fraud or Deceit
• Intentional infliction of emotional distress
• Trespassing (land & property)

Strict Liability

Torts which are considered strict liability involve cases where the responsibility for the injury is imposed on the wrongdoer without proof of negligence. Prime examples of strict liability torts include:
• Defective products – Product Liability
• Animal attacks – Dog Bite Lawsuits

Negligence Torts

Negligence is by far the most common tort case. Different from intentional torts, negligence cases don’t involve deliberate actions. Negligence happens when someone fails to act carefully, and another person is injured as a result. Examples of negligence torts include:
Car Accidents
• Bicycle Accidents
Motorcycle Accidents
Truck Accidents
• Pedestrian Accidents
Medical Malpractice
Slip and Falls
